Mold Inspection Before Selling a Palm Beach County Home: What Florida Law Requires

You fixed the leak under the sink two years ago. A company checked the area after, said it was dry, and you moved on. Now, you are selling your home. Your agent says that mold has to be shared in Florida.

An as-is clause will not help you here. Florida law looks at what you knew, not just how you wrote the contract. In Palm Beach County, the price of a claim after the sale is much higher than the cost of a test done before you list the home.

Selling "As Is" in Florida Does Not Remove a Mold Disclosure Duty

Many sellers think that an as-is clause gives all the risk to the buyer. But for many years, Florida courts have said this is not true. In Johnson v. Davis (1985), the Florida Supreme Court said sellers have to share any known big problems that buyers cannot spot during a regular visit. Mold that is behind drywall, in HVAC ducts, or under floors fits this rule.

The as-is defense was challenged in Levy v. Creative Construction Services of Broward, Inc., 566 So. 2d 347 (Fla. 3d DCA 1990). The court said that as-is wording can’t remove the duty to tell people about any hidden problems you know about. If you saw stains close to an air handler, there was a slow leak, or you smelled something musty by a wall, you still have to say what you know. That does not go away just because of what is in the contract.

South Florida homes have a special risk here. Post-storm mold can grow inside walls for weeks, and you may not even see any signs. Many sellers who have not done the test will think there is nothing more to share, until a buyer gets a lab report that shows a problem.

What a Post-Closing Mold Claim Costs a Palm Beach County Seller

According to the Realtors Association of the Palm Beaches, the median sale price for a single-family home in Palm Beach County was $632,500 in December 2025. If you buy a home, and then you find mold after, you can ask for the costs to remove it. You can also get money for not being able to use the home, and for when the value of the home goes down. If it is proven that there was a cover-up, the court can totally undo the sale. That means everything goes back to how it was before you bought the place.

A pre-listing test creates a paper record. It shows what was found, the time it was found, and who found it. This record stays with the file. Without it, there could be questions about the water history of the home if there is a court case. Florida Law Bans the Same Company From Testing and Treating Your Mold

This is the step where many sellers go wrong and lose all the progress they made. Florida Statute Section 468.8419(1)(d) says that a mold tester can not give removal services for any place they checked in the past year. Section 468.8419(2)(d) has a similar rule. A cleanup business can not offer to test a place they have worked on in the past year. Both rules must be followed when the mold area is bigger than 10 square feet, as explained in Florida Statute Section 468.8411.

Any company that tries to test and clean on the same property is going against Florida law. This goes for firms that try to get work by giving "free checks" and then push cleanup work. A report from a company that makes money from the results will not stand if there is a dispute over what was found.

The Florida Department of Business and Professional Regulation gives out different licenses for assessors (MRSA) and cleanup firms (MRSR). The person doing your pre-listing test needs to have an active MRSA license. This person should not have any interest in the cleanup job that comes after.

What a Pre-Listing Mold Test in Palm Beach County Covers

A licensed mold test has someone look at the whole place, check for damp spots, use cameras that can pick up heat in walls and ceilings, and take air samples. In Florida, the rules say there must be at least one air sample from inside and one from outside. The outside sample is important in Palm Beach County. Spore counts are always high in South Florida, no matter the year. If testers have no starting point with the outside sample, there is nothing to compare higher indoor numbers to, and no one-including buyers or a court-can make sense of the numbers they get.

Lab results come back in 24 to 48 hours. The written report shows the kind of mold found. It tells you the spore counts for each room and where the wetness causing the growth came from. This paper goes in your disclosure file and is given to the buyer's agent with the contract. It shows what shape the property was in on a certain date before the sale closed.

Does an "as is" sale in Florida mean I don't have to disclose mold?

No. An as-is clause does not take away the seller's need to say what they knew before. Even if the buyer's inspection did not find anything, the seller still has to share what they know about any old leaks or mold issues. The Florida Second District Court of Appeal made this clear in Jensen v. Bailey, 76 So. 3d 980 (Fla. 2d DCA 2012).

Can the company that removed my mold also do my pre-listing test?

You cannot do this by law. Florida Statute Section 468.8419(2)(d) says a mold cleanup team cannot test a place where they fixed mold in the past 12 months. If this rule is broken, it starts as a second-degree offense and becomes a bigger crime-for a third time, it turns into a third-degree crime under Section 468.8419(3). Before you hire someone, see if your assessor has a MRSA license that is still good by going to the Florida DBPR's website and checking the online license search.

How long does a pre-listing mold test take in Palm Beach County?

Most single-family homes need two to three hours for a full check. This includes air testing, checking for water, and looking at all parts with heat pictures. Lab results come in 24 to 48 hours. A written report with photos for each room is usually out in 48 hours after we visit your home.

Your Disclosure File Needs a Date on It

A mold test does not make a problem. It gives you a record. If you test the home before you put it up for sale, you know what you have to share with others. If you do not do this, you might find out there is a problem after the sale does not go through.
